Know Your Rights - ICE Shows up at Home or Approached in Public

We want to remind everyone of their rights regarding federal immigration operations.

If ICE Agents come to your Home or Resident - you have the right to:
  • NOT to open your door unless the immigration agent knocking has a warrant signed by a judge or magistrate with your name on it
  • REMAIN SILENT and not answer any questions from immigration agents
  • NOT SIGN ANY PAPERS without first talking with an attorney
  • TALK TO AN ATTORNEY at your own expense

If approached by ICE:
  • You do not have to reveal your immigration status and have the right to remain silent
  • You do not have to sign any documents without consulting an attorney
  • You have the right to ask, “Am I free to go?”

Talking Points to use with an ICE agent, police, or law enforcement officer:
  • “I do not wish to speak with you, answer your questions, or sign or hand you any documents based on my 5th Amendment rights under the United States Constitution
  • “I do not give you permission to enter or search my home based on my 4th Amendment rights under the United States Constitution unless you show me a warrant to enter that is signed by a judge or magistrate.”
  • “I do not give you permission to search of my belongings based on my 4th Amendment rights under the United States Constitution.”
  • “I choose to exercise my constitutional rights.”
